The Montana Medical Marijuana Act, Initiative 148, MCA 50-46-201 or whatever else you like to call it, is the law that is on the books in the state of Montana regarding medical cannabis use.
The short summary of the law is as follows.
A person with a debilitating condition as defined in the context of the law can use marijuana, cannabis, as a treatment for their condition with the recommendation of a state licensed physician or DO. Once they have the recommendation and have sumbitted it with their Montana Medical Marijauan Program Patient Application and recieved their MMMP card they can grow their own cannabis and, if they desiganted a caregiver when they submitted their application, purchase medicine from their designated caregiver. The patient is allowed six (6) plants and one (1) ounce of usable cannabis, the patients designated caregiver may grow an additional six (6) plants and possess one (1) ounce of usable cannabis on behalf of the patient.
The law is silent on where to obtain seeds, clones or anything else pertiaing to growing cannabis.
A person can be a caregiver as long as they are not a convicted felon relating to a drug offense. In order to be a caregiver you must have a patient designate you as their caregiver when they submit their application to the Department of Public Health & Human Services in Helena.
It is your responsibility to know and understand the law as the law enforcement agencies in the state of Montana are not well versed in the law and sometimes do not cite it accordingly.
